Terms & Conditions

PREAMBLE 

Aleksandra Viktor GmbH, Marienstraße 22 in 10117 Berlin Germany operates an online shop under the name ALEKSANDRAVIKTOR via the website www.aleksandraviktor.com (“we”) for exclusive fashion. The following General Terms and Conditions apply to the purchase of goods in our online shop. Divergent or contradictory terms and conditions are only valid in the case that we have expressly approved them in writing. 

CONCLUSION OF CONTRACT 

The depiction of goods in our online shop is not legally binding.  By clicking on the button “Order with Obligation to Pay”, you conclude a legally binding sale contract for the item(s) in your shopping bag.  Once we have received your order, you will receive a confirmation e-mail from us. The order confirmation in no way confirms that your order has been successful, but is simply meant to inform you that we have received your order.  You will be notified that your order was successful by a second e-mail, which confirms that the item(s) you ordered are available and ready for dispatch. You will receive confirmation of dispatch at the latest 7 (seven) days after we have received your order.  Please note that in case we will not be able to dispatch your order we have the right to cancel this contract with no legal consequences for us. We will immediately wire your money back on the account you gave us by your order.  You are not allowed to sell our goods to any third party without our official approval. 

SHIPPING COSTS

All prices shown in our online shop include the German statutory value added tax.  All prices include packaging and delivery costs inside the EU.  Delivery to countries outside of the EU and to Switzerland cause extra costs (50 EUR) that will be charged to you with your order. As far as no alternative arrangements have been made, deliveries are made to the delivery address that you have given us.  We will ship the goods once the payment has been made.  Delivery time within Germany is approx. 7 working days and within Europe approx. 14 working days.  Please do note that we are not responsible for any delayed deliveries caused by the shipping company.  

PAYMENT 

You can pay for the purchased item(s) by credit card, payment in advance or with PayPal.  You have to make the payment while placing the order. We will dispatch only paid orders. We have the right to refuse the payment and cancel the contract without any special reason.  We reserve the right to claim higher compensation for damages caused by default of payment. We reserve ownership of the dispatched items until full payment of the purchase price for the respective items has been received.

CANCELLATION RIGHTS 

As a consumer in the meaning of § 13 of the German Civil Code (Bürgerliches Gesetzbuch), you have the right to cancel this contract without giving a reason within 14 days.  The cancellation period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, take possession of the goods. To exercise your right of withdrawal, you must send an email to aleksandra@aleksandraviktor.com as a clear declaration detailing your decision to rescind this contract.  In order to observe the deadline for cancellation it is sufficient to send notification stating that you wish to exercise your right of cancellation before expiry of the cancellation period.

RETURNS

When shopping online, please be conscious of your consumption. Processing returns has an environmental impact and AV consider free returns to be an unsustainable cost and effort.

Please note that we therefore do not cover the shipping costs of returns. After exercising your right to withdrawal please send the goods back to:  Aleksandra Viktor GmbH Marienstraße 22 10117 Berlin. Please note that we only accept returns at our discretion after and that you are obliged to send us a tracking number of the sending and make sure that the parcel is insured.  Please note that we can only accept returns from the country which the shipment was sent to.

REFUND

Please note that all refunds are at our discretion. Should you cancel this contract, we will refund all costs we have received from you, with the exception of additional costs that may arise should you choose a different type of delivery than the standard, lowest priced we offer.  We will refund your payment once we have received the goods back from you.  Once your return is received and inspected, we will send you an email to notify you that your refund has been accepted or rejected.  Please note that we will refund your payment only if all items are unused and exactly in the same condition that you received it, including the cotton bag that the items were shipped in. In refunding you, we will use the same payment method and the same bank account details you used for your original transaction unless otherwise expressly agreed. EXCHANGE

If, for some reason, you are unhappy with your choice of coat, we are happy to exchange the coat with another one (if available) at our discretion. Please note that the shipping costs of the exchange will be covered by AV within Germany and the EU, but have to be covered by yourself if outside of the EU.

GUARANTEE 

All items on aleksandraviktor.com are designed by Aleksandra Viktor GmbH. All items are provided with the original identification label and a product information label. In case the item does not satisfy you and you wish to return it, it is important that you do not remove the label and the seal. The main features of each product are listed on www.aleksandraviktor.com in separate descriptions.  The images and colors of the items on the web site might not correspond to the real colors depending on the web navigator and the screen you are using. However, we try our very best to show colors as close as possible to reality. The items are made of very sensitive fabrics, please follow the advice on the care label. Please try to avoid rain, if possible.  We provide a warranty for defect items, either by rectification or by substitute delivery of a defect- free item (so-called subsequent performance), at your discretion. Regarding other claims arising from a defect, you must allow us an amount of time as is reasonably necessary to assert such claims. We may refuse the type of supplementary performance you selected if such performance is only possible at disproportionate expense. 

GOVERNING LAW 

You may only transfer claims against us to which you are entitled with our express consent. § 354 -5-  (a) of the German Commercial Code (Handelsgesetzbuch) remains unaffected.  The legal relationship existing between the parties is governed exclusively by German law to the exclusion of the UN Convention on Contracts for the International Sales of Goods (CISG).  Insofar as you are a business person, a legal entity under public law, or a special fund under public law, the exclusive court of jurisdiction for all disputes arising from or in connection with this contractual agreement is Berlin. We also reserve the right to sue you at your general place of jurisdiction.  In the event that individual provisions of this agreement are or become invalid or unenforceable, this shall not affect the validity and enforceability of the other provisions.
